4. JURISDICTION
Roaming Studio Pty Ltd is created and controlled in Victoria, Australia. All purchases are subject to the laws of the Commonwealth of Australia, and where applicable the state of Victoria and use of the Site will as far as legally possible be governed by the laws in existence from time to time in Australia. By using this site you submit to the jurisdiction of the courts of Victoria and Australia and agree that any legal action will only be commenced in these forums.
5. TERMINATION
These terms are effective even if this Agreement is terminated by either party. Subject to applicable law, we reserve the right to suspend or deny, in our sole discretion, your access to all or any portion of the Site with or without notice. You agree that any termination of your access to the Site may be effected without prior notice, and acknowledge and agree that we may immediately deactivate or delete your registration and all related information and files under your registration and bar any further access to such files or the Site. Further, you agree that we shall not be liable to you or any third-party for any termination of your access to the Site.
6. SETUP
Upon receiving orders for web services such as web site hosting we will process the order as soon as possible. Web hosting access can be delayed typically by around 24 to 48 hours because of initial administration setup and DNS (Domain Name Server) Propagation.
7. FAIR USE
Web hosting packages with unlimited traffic and space features are subject to our Fair Use Policy by Roaming Studio Pty Ltd. All web hosting accounts are intended for normal personal or business use and are not appropriate for large data transfers such as file hosting web sites or sites that would normally be deemed to require a dedicated server. This Fair Use Policy is in place to provide a quality service for all customers. Customers should discuss their hosting requirements with Roaming Studio Pty Ltd staff prior to purchase specifically outlining traffic requirements. 'Unlimited' termed resources are resources provided to customers to meet sufficient demands, however 'unlimited' should not be taken advantage of and are subject to reasonable use. Accounts where excessive use of resources which place undue demand on servers and affect other clients may have there accounts suspended or terminated.
8. ILLEGAL ACTIVITY & INAPPROPRIATE MATERIAL
Roaming Studio Pty Ltd does not condone use of web hosting service for any illegal or unlawful activity and does not hold any personal responsibility for clients activities. Any material deemed to be illegal or inappropriate to be display will be removed, and Roaming Studio Pty Ltd reserves the right to suspend any accounts indefinitely as a result of this activity.
9. LIABILITY
You agree to indemnify and hold harmless Roaming Studio Pty Ltd from any loss, liability, claim, damage and expense arising from or related to your content or use of any services provided by Roaming Studio Pty Ltd. If you are not satisfied with these terms and conditions then you must discontinue use of our hosting services.
You accept legal responsibility for use of the account, are at least 18 years of age or (if younger) have your parent's or legal guardian's permission before using our services.
10. RESPONSIBILITY
You are responsible for any misuse of our services, even for example, if the misuse was committed by a friend, family member, guest, employee or customer with access to your account or website. You are also responsible for any such misuse regardless of whether it was with or without your consent. Therefore, you must take steps to ensure that others do not gain unauthorised access to your account or website.
11. DOMAIN NAMES
Domain names may be registered through a third party on your behalf. Failure to provide adequate details for registering may result in delays. Roaming Studio Pty Ltd does undertakes checks for availability of domain names, however Roaming Studio Pty Ltd does not hold any responsibility if domain name is unavailable at time of registration even if accepted funds, in such case a refund will be provided to the amount of the domain.
1. SECURITY
When purchasing products from our online store we will request some personal information. This information is used to process your order, Roaming Studio Pty Ltd is committed to ensuring your privacy and will use your information only in accordance with the terms of this Privacy Policy. We will not distribute, rent or sell your personally identifiable information or a list of our customers to third parties without your consent. We must however cooperate fully with the law, should a situation arise where we are required by law to give out personal details we will only provide as much as legally required.
2. PAYMENT INFORMATION
Roaming Studio Pty Ltd will use PayPal for all online payment transactions. Therefore, your payment information will not be stored on the Roaming Studio web site. PayPal is a recognised payment service provider, for further information about PayPal please refer to their website www.paypal.com.
3. REGISTRATION INFORMATION
Information collected by Roaming Studio Pty Ltd is used in the following ways when you register on the Site:
(i) to process customer orders and payment,
(ii) to contact our customers concerning the status of an order or to answer any of their questions.
(ii) All information we keep is in your customer profile and can be edited by you at any time.
Information collected by Roaming Studio Pty Ltd when you opt-in to join our mailing list is used deliver or transmit to you information about upcoming sales, promotions and new products via our newsletter.
You may opt-out of the mailing list at any time by emailing sales@roamingstudio.com.au.
4. CUSTOMER CORRESPONDENCE
If you decide to purchase a product from our store we may contact you if necessary to confirm any delivery information or other details in relation to your order.
If you send us correspondence, including emails, letters and faxes, we will retain such information in the records of your account. We will also retain all order, customer support and other correspondence from Roaming Studio Pty Ltd to you. We retain these records so that we can help you in the future should it be necessary to refer back to your purchasing history and so we can measure and improve our Customer Support. We may, over time, delete these records if permitted by law.
5. WEB SITE TRAFFIC
When you view or leave the Roaming Studio web site, we automatically receive the web address of the site that you came from or are going to. When you browse through our site, we collect information on the efficiency and workings of our web site. We only use this information to improve and personalize your shopping experience and to manage our websites performance. All such information is stored in a secure manner and is generic. It does not include any personally identifiable information.
